1. Acceptance of these terms

By accessing or using the website at groupdesignbuild.com (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site.

These Terms govern your use of the Site itself. They do not govern professional services we provide under separate signed agreements (architecture, construction, or design-build), which are subject to their own contracts.

The Site is operated by Group Design Build, Inc., a Massachusetts corporation with a principal place of business at 425 Watertown St., Newton, MA 02458 ("we," "us," "our").

3. Permitted use of the Site

You may use the Site for personal, professional, and lawful purposes. You agree not to:

  • Use the Site in any way that violates applicable law or regulation

  • Attempt to gain unauthorized access to any part of the Site or its underlying systems

  • Use automated tools (scrapers, bots) to extract data from the Site, except for standard search-engine indexing

  • Reproduce, redistribute, or modify content from the Site without our written permission, except as expressly permitted under Section 4

All content on the Site — including text, photographs, drawings, diagrams, project images, video, audio, logos, and design elements — is the property of Group Design Build, Inc. or our licensors, and is protected by United States copyright, trademark, and other intellectual property laws.

You may view and print pages from the Site for personal, non-commercial reference. Any other use — including reproduction, public display, or commercial distribution — requires our prior written consent.

Project photographs may depict work performed for clients with whom we have signed photo-release agreements. Use of those photographs is also subject to those underlying agreements.

5. Submissions and contact information

If you submit information through a contact form, by email, or by any other means, you grant us permission to use that information to respond to your inquiry and to contact you about our services. Any unsolicited ideas, designs, or proposals you submit are submitted at your own risk. We are not obligated to keep them confidential and assume no obligations with respect to them.

6. Professional information disclaimer

Content on the Site is provided for general informational purposes only. It does not constitute architectural, engineering, construction, real estate, financial, or legal advice. Project descriptions, performance figures, cost ranges, and timelines are illustrative and may not apply to your specific circumstances.

Engagement of architectural or construction services from Group Design Build, Inc. requires a written agreement signed by both parties. Nothing on the Site creates a client relationship or a contract for services.

7. Third-party links and embedded content

The Site may link to or embed content from third parties (e.g., Vimeo, Google Maps, social media platforms). We are not responsible for the content, privacy practices, or terms of use of those third parties. A link to a third-party site is not an endorsement.

8. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Group Design Build, Inc. and its directors, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.

In no event will our total aggregate liability for any claim arising out of or related to the Site exceed one hundred United States dollars (USD $100).

This limitation applies whether the claim is based on contract, tort, statute, or any other legal theory.

You agree to defend, indemnify, and hold harmless Group Design Build, Inc. and its directors, officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

12. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws provisions. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, and you consent to the personal jurisdiction of those courts.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
